O serán insuficientes los aportes del Derecho en este examen, teniendo en cuenta no solo el vertiginoso avance que la ciencia médica ha alcanzado en los últimos años, sino, también, el hecho de (...) que la prestación de servicios de salud se desarrolla dentro del complejo sistema de seguridad social en salud, el cual es el responsable de reglamentar la prestación de servicios de salud en el país. A “Critical Perspectives” article in the Journal of Bioethical Inquiry on scientific integrity in Brazil summarizes several misconduct cases documented therein . To further reinforce the responsible conduct of research in developing countries and to fight against the unaccountability of many editors , we describe here a Mexican instance of alleged in-house plagiarism .In June 2011, we submitted a “Correspondence” note to a Nature group journal to expose what we claimed to be a breach of collegiality and inappropriate authorship in (...) a three-page mutation report just published in that journal. Our main complaints were two: the surreptitious way in which we believed that both displayed metaphases in that report had been obtained from our files by a local colleague and then published without our consent and the massive easy-on co-authorship: 14 out of 21 co-authors declared just to have “provided clinical material.” In c .. Community consultation is increasingly recommended, and in some cases, required by ethical review boards for research that involves higher levels of ethical risk such as international research and research with vulnerable populations. In designing a randomised control trial of a mental health intervention using a wait list control, we consulted the community where the research would be undertaken prior to finalising the study protocol. The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be avoided. (...) Insofar as the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Este trabajo desarrolla una propuesta de análisis en torno a los repertorios de acción que pusieron en cuestión los símbolos de la nación moderna y al proyecto urbano neoliberal, como elementos civilizadores. Proponemos que la narrativa monumental ha sido tensionada por el despliegue de una producción estética que ha revelado sus violencias y exclusiones históricas. El centro de Santiago fue el escenario donde se desplegaron diversos repertorios que hablan de las múltiples temporalidades que habitamos, entre ellas la temporalidad colonial. En (...) este sentido, creemos que la Revuelta tuvo un carácter chi’xi, siguiendo las ideas de Silvia Rivera Cusicanqui, es decir, operaron repertorios y estéticas yuxtapuestas desde donde se impugnaron las políticas de identidad del estado chileno. Asimismo, como parte de este proceso, se desplegaron nuevos usos, significados y nombres en el espacio urbano, a modo de un quehacer insurgente cuya densidad retorica todavía nos desborda, sigue abierto y en disputa. En general, todas las emociones comparten ciertas características que les son inherentes: tienen conductas asociadas y tienen objetos intencionales; además, en las emociones recalcitrantes el sujeto hace un juicio sobre el objeto intencional que entra en conflicto con la emoción. Un caso típico es el miedo a volar: una persona se rehúsa a volar en avión, pero juzga que no hay nada que implique peligro en esa acción. The philosophy devoted to the sacred knowledge of Athena has suffered an undeniable castration in modernity, because, following Sloterdijk, it has been related to the cynic, subjugation to appearance. For this reason, German literature differentiates between Kynismus and Zynismus. The kynysmós with "k" refers to the wise dogs of the agora and the Zynismus to the toothless Papillon. Under the keys of modernity, philosophy is camouflaged in moderation, good saying and salon etiquette, thereby abandoning the stridency, sarcasm and challenge that (...) the school of Diogenes practiced; but what was that insolence? What was his speech? What were his gestures? These are some of the questions addressed in this article; therefore, the reflection on the figure of the cynic, by the hand of the author of Critique of Cynical Reason, has been central to elucidate some of these questions and, why not, obscure them, after all, the interstices of the words are deeper. For methodological reasons, the text is divided into three sections: first, Resonances of a supplanted concept, in which the link between insolence and the cynical is investigated; second, Philosophical gestures, where the grimaces of an impertinent thought are drawn and third, Conclusions. In recent years, several countries have enacted guidelines and/or mandatory laws to increase the presence of women on the boards of companies. Through these regulatory interventions, the aim is to eradicate the social and labor grievances that women have traditionally experienced and which has relegated them to smaller-scale jobs. Nevertheless, and despite the advances achieved, the female representation in the boardroom remains far from the desired levels. In this context, it is now necessary to enhance the advantages of board gender (...) diversity from both ethical and economic points of view. This article examines the relation between board gender diversity and economic results in Spain: the second country in the world to legally require gender quotas in boardrooms and historically characterized by a minimal female participation in the workforce. Based on a sample of 125 non-financial firms listed on the Madrid Stock Exchange from 2005 to 2009, our findings show that in the period analyzed the increase of the number of women on boards was over 98 %. This suggests that compulsory legislation offers an efficient framework to execute the recommendation of Spanish codes of good governance by means of the increase in the number of women in the boards of firms. Furthermore, we find that the increase in the number of women on the boards is positively related to higher economic results. Therefore, both results suggest that gender diversity in boardrooms should be incremented, mandatory laws being a key factor to do so. (shrink)

En medio de un desencanto social por un sistema político corrupto y reacio al cambio democrático, desde los años setenta el género neopolicial irrumpió en México, abandonando las temáticas propias de la novela policial clásica que se encontraban centradas en la resolución de crímenes por detectives cuya inteligencia y habilidades permitían hacer justicia y reestablecer el orden social. Una vez que al país llega la alternancia política las autoridades de gobierno en turno utilizan los medios masivos de comunicación para difundir (...) un discurso ideológico que ubica en el narcotráfico al enemigo nacional y generador de la violencia en el país. En este artículo se asume que las características propias del género neopolicial apoyan la construcción de imaginarios sociales que son críticos a las narrativas estatales que intentan explicar y justificar la violencia en el país. This work presents a causal conception of metaphysical modality in which a state of affairs is metaphysically possible if and only if it can be caused (in the past, the present or the future) by current entities. The conception is contrasted with what is called the "combinatorial" conception of modality, in which everything can coexist with anything else. This work explains how the notion of 'causality' should be construed in the causal theory, what difference exists between modalities thus defined from (...) nomological modality, how accessibility relations between possible worlds should be interpreted, and what is the relation between the causal conception and the necessity of origin. Technologies that deploy data science methods are liable to result in epistemic harms involving the diminution of individuals with respect to their standing as knowers or their credibility as sources of testimony. Not all harms of this kind are unjust but when they are we ought to try to prevent or correct them. Epistemically unjust harms will typically intersect with other more familiar and well-studied kinds of harm that result from the design, development, and use of data science technologies. However, (...) we argue that epistemic injustices can be distinguished conceptually from more familiar kinds of harm. We argue that epistemic harms are morally relevant even in cases where those who suffer them are unharmed in other ways. Via a series of examples from the criminal justice system, workplace hierarchies, and educational contexts we explain the kinds of epistemic injustice that can result from common uses of data science technologies. What does it mean to trust the results of a computer simulation? This paper argues that trust in simulations should be grounded in empirical evidence, good engineering practice, and established theoretical principles. Without these constraints, computer simulation risks becoming little more than speculation. We argue against two prominent positions in the epistemology of computer simulation and defend a conservative view that emphasizes the difference between the norms governing scientific investigation and those governing ordinary epistemic practices.

Este trabajo profundiza en un momento importante en la historia de la comunicación como lo fue el de la difusión de la imprenta y el desarrollo de las técnicas del grabado aplicadas a la impresión. Se estudian las imágenes del libro bíblico del Apocalipsis, ilustrado por el artista alemán Alberto Durero a finales del siglo XV. Para ello se ha ahondando en el contexto histórico en el que fueron producidas, en la personalidad y circunstancias que rodearon la vida del artista (...) y en las propias imágenes xilográficas rastreando sus antecedentes y características propias. This work focuses on an important moment in the history of communication such as the diffusion of the printing press and the development of the engraving techniques applied to printing. It studies in depth the images of the biblical book of the Apocalypse illustrated by the German artist Alberto Durero by the end of the fifteenth century. This article analyzes the historical context where they were produced, the personality of the artist and the circumstances surrounding his life, and the very own xylographic images, whose antecedents and characteristics are traced. In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

Edited by Ivette Fred-Rivera and Jessica Leech. What is the relationship between ontology and modality: between what there is, and what there could be, must be, or might have been? Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

We address some of the epistemological challenges highlighted by the Critical Data Studies literature by reference to some of the key debates in the philosophy of science concerning computational modeling and simulation. We provide a brief overview of these debates focusing particularly on what Paul Humphreys calls epistemic opacity. We argue that debates in Critical Data Studies and philosophy of science have neglected the problem of error management and error detection. This is an especially important feature of the epistemology of (...) Big Data. In “Error” section we explain the main characteristics of error detection and correction along with the relationship between error and path complexity in software. In this section we provide an overview of conventional statistical methods for error detection and review their limitations when faced with the high degree of conditionality inherent to modern software systems. Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

As intergenerational interactions increase due to an ageing population, the study of emotion-related responses to the elderly is increasingly relevant. Previous research found mixed results regarding affective mimicry – a measure related to liking and affiliation. In the current study, we investigated emotional mimicry to younger and older actors following an encounter with a younger and older player in a Cyberball game. In a complete exclusion condition, in which both younger and older players excluded the participant, we expected emotional mimicry (...) to be stronger for younger vs. older actors. In a partial inclusion condition, in which the younger player excluded while the older player included the participant, we predicted that the difference in player behaviour would lead to a difference in liking. This increased liking of the older interaction partner should reduce the difference in emotional mimicry towards the two different age groups. Results revealed more mimicry for older actors following partial inclusion especially for negative emotions, suggesting inclusive behaviour by an older person in an interaction as a possible means to increase mimicry and affiliation to the elderly. RESUMO O intuito deste artigo é estudar o objetivo principal da estética musical de Boulez, para o início das comemorações de seus 90 anos, desde certas categorias de Deleuze, considerando que elas nos permitem compreender e delinear uma lógica da sensação sonora. Se Deleuze se ocupou em detalhe do trabalho de Francis Bacon, por exemplo, a fim de criar uma "lógica da sensação visual" em que o conceito de "Figura" fosse central, propomos que o trabalho musical de Boulez, analisado a (...) partir do pensamento de Deleuze, possa mostrar os momentos decisivos de uma "lógica da sensação sonora." Por meio de alguns trabalhos de Boulez podemos ver dois elementos muito importantes para nossa pesquisa dados na estrutura instalada pela filosofia de Deleuze. Esses dois elementos que darão forma a este artigo são: as "figuras" da música e as "forças" do som expressivo. ABSTRACT This article aims to study the main objective of musical aesthetics of Boulez, to begin to commemorate 90 years, since certain categories of Deleuze, as they allow us to understand and outline a logic of sound sensation. If Deleuze worked in detail the work of Francis Bacon, for example, to create a "logic of visual sensation" where the concept of "Figure" is central, we propose that the musical work of Boulez, analyzed from Deleuze's thought, be possible to show the decisive moments of a "logic of sound sensation." Along some works by Boulez we can see two very important elements for our research in the framework installed Deleuze's philosophy are given. These two elements will shape this article are: the "figures" of music and the "forces" expressive sound. (shrink)
